A program is a set of instructions to a processor, a compiler,
or so on. A PKGBUILD is a set of instructions to a PKGBUILD 
intepreter or somesuch thing. No essential difference there.
A PKGBUILD is a derivate work of the packages it uses. 

Suppose I start a project, that includes a Makefile, a few
patches, and the Makefile pulls the sources of some other
project, pathces it, and compiles it. Wouldn't you say, that
it's a derivative work of the package it pulls? It doesn't
matter if it actually is distributed with the code; it
nevertheless depends on it, and therefore makes a derivative
work. But this is what a PKGBUILD essentially is.
